OuterFactor® Limited Warranty
OuterFactor® (“OuterFactor®”) warrants its products (collectively, “Products”) against defects in manufacturing, material, or workmanship under normal use and service for the period(s) indicated below, subject to conditions contained in this limited warranty. This Limited Warranty applies only to Products purchased from an OuterFactor® authorized partner. OuterFactor® reserves the right to reject warranty claims from purchasers of OuterFactor® Products purchased from unauthorized sellers.
Warranty Period
Product warranty periods are as follows: For OuterFactor® WorkForce™ tablet cases, Element™ phone cases, and OnGuard™ screen protectors, the lifetime of the Product, which is five (5) years from the original date of purchase of the Product from an authorized partner. For all other cases, accessories, electronics, and Products not listed above, one (1) year from the original date of purchase of the Product from an authorized partner.
Exclusions and Limitations
This Limited Warranty does not cover any damage to any non OuterFactor® Product used in connection with an OuterFactor® Product. This Warranty does not apply to, or cover any damage due to misuse, mishandling, improper installation, neglect, accident, tampering, modification or alteration in any way, or normal wear and tear including discoloration.
Sole and Exclusive Remedy
If a warranty claim is approved by OuterFactor®, OuterFactor® will at its option: (1) replace the defective OuterFactor® Product or (2) replace the defective OuterFactor® Product with a Product of equal or greater value if the original Product is no longer available or out of stock. Replacement Products are warranted as above only for the remainder of the original applicable Limited Warranty period. This Limited Warranty is customer’s sole and exclusive remedy for defective OuterFactor® Products and only applies to and is non-transferrable from the original end-user purchaser.
Warranty Disclaimers
THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THOSE STATED HEREIN. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUTER FACTOR SPECIFICALLY DISCLAIMS AND EXCLUDES ANY AND ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF NON-INFRINGEMENT, QUIET ENJOYMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF SUCH DISCLAIMER OF ANY IMPLIED WARRANTY IS NOT PERMITTED BY LAW, THE DURATION OF SUCH IMPLIED WARRANTY IS LIMITED TO THE DURATION OF THE LIMITED WARRANTY PERIOD APPLICABLE TO THE OUTER FACTOR PRODUCT AS SET FORTH ABOVE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF APPLICABLE LAW SPECIFIES A MINIMUM LIMITED WARRANTY PERIOD THAT IS LONGER THAN THE APPLICABLE LIMITED WARRANTY PERIOD SET FORTH IN THIS LIMITED WARRANTY, THEN THE APPLICABLE LIMITED WARRANTY PERIOD FOR OUTER FACTOR PRODUCTS SUBJECT TO SUCH APPLICABLE LAW WILL BE CONFORMED TO THE MINIMUM PERIOD SO REQUIRED. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.
Limitation of Liability
IN NO EVENT SHALL OuterFactor® BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF THE USE OF AN OuterFactor® PRODUCT, INCLUDING, WITHOUT LIMITATION, PROPERTY DAMAGE, LOSS OF VALUE OF AN OuterFactor® PRODUCT OR ANY THIRD-PARTY PRODUCTS THAT ARE USED IN OR WITH AN OuterFactor® PRODUCT, OR LOSS OF USE OF AN OuterFactor® PRODUCT OR ANY THIRD-PARTY PRODUCTS THAT ARE USED IN OR WITH AN OuterFactor® PRODUCT, EVEN IF OuterFactor® HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OuterFactor® HAS NO LIABILITY FOR ANY DAMAGE OR DESTRUCTION TO ELECTRONICS DEVICES OR OTHER PERSONAL PROPERTY THAT ARE CONTAINED INSIDE OR OUTSIDE OuterFactor® PRODUCTS, INCLUDING, WITHOUT LIMITATION, TABLETS, LAPTOPS, SMARTPHONES OR OTHER HANDHELD DEVICES, OR ANY LOSS OF DATA CONTAINED IN THE FOREGOING DEVICES. NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL DAMAGES REFERENCED HEREIN AND ALL DIRECT OR GENERAL DAMAGES IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE), THE ENTIRE AGGREGATE LIABILITY OF OUTER FACTOR AND ANY OF ITS DISTRIBUTORS, SUPPLIERS, AND/OR AUTHORIZED PARTNERS, WILL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY CUSTOMER FOR ANY PRODUCT GIVING RISE TO LIABILITY. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. THE LIMITATIONS OF LIABILITY SET FORTH ABOVE WILL APPLY TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.

To submit a warranty claim, please visit our support page. All claims must be accompanied by proof of purchase from an authorized OuterFactor® partner, and we reserve the right to request pictures of the Product that is subject to the warranty request. OuterFactor® reserves the right to charge a shipping and handling fee in connection with any warranty evaluation or fulfillment.
